Worker’s compensation is a form of wage replacement, insurance, and medical benefits for workers who are injured on the job and can no longer work. The Worker’s Compensation Board is a state agency that helps deal with the claims, they determine whether the employee was actually injured on the job or not. The board also helps decide the weekly cash benefits and medical care that will be paid by the employer’s insurance. While arrangements can be different between agencies, plans can be made for payments in place of reimbursement or payment of medical and other expenses. However if the employer or its insurance disputes the workers compensation claim the employee will not receive the benefits until the workers’ compensation law judge decides who is right or wrong in the situation.
When an employee makes a claim to the employer’s insurance for reimbursement of the cost of the treatment related to the work related injury the insurance has 45 days to pay the claim. The insurance must pay any undisputed portion or notify the employee in writing within 45 days of receipt of the claim that the claim is not being paid and why the insurance is not being paid.
